Vezmar reveals that after he took his date out for pizza, they both went to see Guardians of the Galaxy 2. His suit is filed against an unidentified 35-year-old woman who was allegedly texting during the film.

When he suggested she step out of the theater to text, she left and never came back.

She said: "I had my phone low and I wasn't bothering anybody".

Vezmar did call his failed date to reimburse him for the movie ticket, but the woman said she refused. "'It wasn't like constant texting". She emphatically stated, "This is insane", and said that Vezmar contacted her a few times to get the price of the ticket back. He said he texted her a few days later asking for the price of the ticket but she refused to pay it.

Well, from his perspective, she was the insane one. According to her, she used a gadget that only two or three times and did not disturb anyone in the audience.

The woman claims her behavior wasn't much of an issue during the screening. But imagine if that person who has a ridiculous obsession with their phone during a movie was your date. Brandon Vezmar, 37, filed the claim on Thursday 11 May after the pair met face-to-face for the first time on the 6 after talking online.

Although this Texas man might be slightly anal-retentive, texting is against the policy of most theaters, disrespectful to the audience and to your date. He claims she activated her phone at least 10-20 times in 15 minutes, reading and sending texts. According to Vezmar, about 15 minutes after the movie began, the woman, who has not been identified, began texting. My best friend needed me right away and you said my phone was driving you insane then I felt so uncomfortable.

Tweeting a link to Brandon's story, he said: 'Why stop at suing? This is the predicament one Marvel fan has found himself in after a trip to see Guardians of the Galaxy Vol. 2 went awry.
